New company wont hire me because I have sleep apnea, can I sue them for discrimination?

Company is saying it was for other reasons, which were not true.

First of all, I don’t see why a company wouldn’t hire you because of sleep apnea. Is this an insurance thing or does the job entail quietly sleeping? I’m not positive on what the discrimination laws are for employment other than, race, creed, religion, sex, etc. You would have to look up the federal statute, and your state statute. They will define classes that are protected, and I’m not sure sleep apnea would fall into a protected class. A disability is defined as something that has adverse effects on your daily life, but generally is limited in it’s scope to mental problems and/or physical handicaps. That’s the best answer I can give for now. Hope it helps. As always, consult a lawyer if you think you have a viable claim.

There is no law protecting sleep apneatics from discrimination.

It certainly seems like discrimination to me. I don’t think they are allowed not to hire you based on something like that. Consult with a lawer to find out, and find out what your options are.

I think it’s certainly worth having a consultation with a lawyer. The main problem is that it will be difficult to prove the reason they did not hire you was your sleep apnea, since they will likely just say it was a different reason.
The only way they might be able to say “yes we didn’t hire that person due to sleep apnea” is if it were outlined in the job requirements that there was something needed that sleep apnea might keep you from doing. However, it sounds like they are claiming other reasons anyway.
